Terms of Service

1.1 — Acceptance of Terms

By creating an account or using My State Scheduler, you agree to these Terms of Service. If you do not agree, you must not use the service. We reserve the right to modify these terms at any time, with notice provided through the app or via email.

1.2 — Eligibility

You must be at least 18 years of age to use My State Scheduler. By using the service, you represent that you meet this requirement and that all information you provide is accurate and complete.

1.3 — Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

1.4 — Acceptable Use

You agree to use My State Scheduler only for its intended purpose of monitoring and securing DPS appointments. You agree not to:

  • Use the service for any unlawful purpose
  • Resell, redistribute, or commercially exploit appointments obtained through the service
  • Provide false or misleading information
  • Attempt to interfere with or disrupt the service
  • Create multiple accounts for the same individual

1.5 — Government Non-Affiliation

My State Scheduler is an independent service and is not affiliated with, endorsed by, sponsored by, or associated with the Texas Department of Public Safety (DPS) or any governmental agency.

All appointments are secured through publicly available official government systems. We do not guarantee appointment availability, timing, or eligibility.

1.6 — Payment & Refunds

Manual search and booking are always free. Auto-Search is a one-time fee, paid when you start a search and priced by the speed tier you choose (Standard, Priority, or Rush). Refunds are available as follows: 100% within 24 hours of purchase and 60% within 7 days; after 7 days, fees are non-refundable except where required by applicable law. Pricing is subject to change with reasonable advance notice.

1.7 — Limitation of Liability

To the maximum extent permitted by law, we and our officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

1.8 — Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any reason at our discretion, with or without notice. Upon termination, your right to use the service ceases immediately.

1.9 — Governing Law

These terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in the State of Texas.

Service Description & Limitations

2.1 — Service Nature

My State Scheduler provides appointment monitoring and reservation assistance for Texas DPS appointments. Our service operates as follows:

  • We monitor publicly available appointment availability through official channels
  • For premium users, we may automatically reserve appointments based on user-defined preferences and availability
  • Users are responsible for confirming appointment eligibility, document requirements, and all DPS regulations
  • We do not guarantee successful booking of any appointment
  • Manual appointment browsing is always available free of charge

2.2 — No Guarantee of Results

My State Scheduler does not guarantee that an appointment will be available, booked, or suitable for your specific needs. Appointment availability is controlled entirely by the Texas Department of Public Safety. We are not responsible for:

  • Failure to secure an appointment within a desired timeframe
  • Appointments that do not match your specific service requirements
  • DPS rejecting your documents, identification, or eligibility
  • Changes to DPS scheduling systems, policies, or availability
  • Technical issues with DPS systems beyond our control

2.3 — Auto-Search

Auto-Search provides automated monitoring and reservation based on the preferences you authorize. When you start an Auto-Search, you authorize My State Scheduler to attempt appointment reservations on your behalf using the information and preferences you have provided.

You will always receive a notification when an appointment is secured. You may cancel or modify your Auto-Search at any time through the app.

SMS Messaging Program

My State Scheduler offers two optional, separate SMS programs in the United States. You can opt in to one, both, or neither. Opting in to one program does not opt you in to the other.

3.1 — Appointment Alerts (Transactional)

By checking "Text me with appointment alerts" in the app and providing your mobile phone number, you consent to receive transactional SMS messages from My State Scheduler about your appointments — including confirmations, reminders, status updates, and changes.

  • Message frequency varies based on your appointment activity.
  • Message and data rates may apply. Check with your wireless carrier.
  • Reply STOP at any time to cancel. Reply HELP for help.

3.2 — Promotional Messages (Marketing)

By checking "Text me with promotional messages" in the app and providing your mobile phone number, you consent to receive marketing SMS messages from My State Scheduler about offers, news, and product updates.

  • Up to 4 messages per month.
  • Consent is not a condition of any purchase or service.
  • Message and data rates may apply.
  • Reply STOP at any time to cancel. Reply HELP for help.

3.3 — Carriers and Delivery

Supported carriers include AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, Boost, MetroPCS, and most other US carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed and depends on factors outside our control.

3.4 — STOP and HELP Behavior

  • Reply STOP to any message to opt out of that program. You will receive a single confirmation message and then no further messages from that program.
  • Reply HELP to receive contact information and program details.
  • Opting out of one program does not opt you out of the other. To stop both, reply STOP to a message from each program.

3.5 — Eligibility and Mobile Number Changes

You must be at least 18 years old, a resident of the United States, and the owner or authorized user of the mobile phone number you provide. If you change or deactivate your mobile number, you must update your account or opt out promptly so that messages are not sent to a number reassigned to someone else.

Government Non-Affiliation Disclaimer

My State Scheduler is not the Texas Department of Public Safety.

My State Scheduler is an independent, privately operated service. We are not affiliated with, endorsed by, sponsored by, or associated with the Texas Department of Public Safety (DPS), the Texas Department of Motor Vehicles (TxDMV), or any federal, state, or local government agency.

All appointment scheduling is conducted through publicly available official government systems. We do not have special access to, priority within, or influence over government appointment systems.

Users are solely responsible for verifying their eligibility, preparing required documents, and complying with all DPS policies and requirements.

User Authorization

Important: Please read this section carefully.

By starting and using Auto-Search, you expressly authorize My State Scheduler to act on your behalf to attempt appointment reservations using the information you provide. This authorization includes:

  • Monitoring appointment availability based on your specified preferences
  • Attempting to reserve available appointments that match your criteria
  • Using your provided information to complete reservation forms
  • Sending you notifications regarding reservation attempts and outcomes

You may revoke this authorization at any time by cancelling your Auto-Search in your account settings. Revoking authorization will not affect any appointments already secured on your behalf.

You acknowledge that by granting this authorization, you accept responsibility for any appointments reserved through Auto-Search, and you understand that My State Scheduler cannot guarantee the accuracy, availability, or suitability of any appointment secured.
